These Terms of Service (“Terms”) govern your access to and use of 1UPheart.com, including its games, website features, user accounts, cloud storage features, and optional 1UP Heart Supporter subscriptions. In these Terms, “1UP Heart,” “we,” “us,” and “our” refer to the operator of 1UPheart.com.

By accessing or using 1UPheart.com, creating an account, or purchasing a subscription, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

1. The Service

1UPheart.com provides browser-based access to retro gaming experiences, game information, account features, cloud save functionality, controls profiles, favorites, and related services.

Basic gameplay access is free. A paid 1UP Heart Supporter subscription supports the operation of the website and provides expanded account features. A subscription does not provide ownership of any game, downloadable game files, virtual currency, prizes, or paid access to game content.

Features may vary by game, console, browser, device, location, account status, or technical availability. Some games or features may be changed, interrupted, or removed when reasonably necessary.

2. Eligibility

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, you may use the service only with the permission and supervision of a parent or legal guardian.

You must be legally able to enter into a binding agreement to purchase a subscription. If you purchase a subscription for another person, organization, or household, you confirm that you are authorized to do so.

3. User Accounts

You are responsible for:

  • Providing accurate account information;
  • Keeping your password and account credentials secure;
  • All activity performed through your account; and
  • Promptly notifying us if you believe your account has been accessed without permission.

You may not share, sell, transfer, or commercially exploit your account. We may require verification before restoring access to an account or changing sensitive account information.

4. Free and Supporter Features

Available account features may depend on whether your account has an active Supporter subscription.

Free accounts may receive limited cloud save and controls-profile storage. Active Supporters currently receive:

  • One cloud save for each exact ROM or game version supported by the service;
  • One controls profile for each supported console; and
  • Continued access to cloud saves already stored in their account after a subscription ends.

The same ROM used by several translated game pages shares the same compatible cloud save. Different regional ROMs or game versions may require separate saves because their save data may not be compatible.

Supporter features are account benefits, not guarantees of permanent compatibility with every game, browser, emulator version, or device.

5. Cloud Saves and Controls Profiles

Cloud saves and controls profiles are provided for convenience. You are responsible for confirming that a save is compatible with the game version you are using.

Saving may overwrite an existing file where the account or subscription limit permits only one applicable save. The website will request confirmation before an existing cloud save is replaced when supported by the interface.

We use reasonable measures to protect stored data, but we cannot guarantee that cloud saves, controls profiles, favorites, or other account data will never be corrupted, lost, delayed, or unavailable. You should download and retain your own copy of any save data that is important to you.

Existing saves currently remain available after a Supporter subscription ends. New saves or additional storage may be restricted until the subscription is renewed. Data may be removed when you delete it, delete your account, violate these Terms, or when storage must be discontinued for legal, security, or technical reasons.

6. Supporter Subscriptions

1UP Heart Supporter is an automatically renewing subscription offered on monthly and annual billing intervals. The price, billing currency, billing interval, and applicable taxes are displayed before you confirm payment.

By purchasing a subscription, you authorize Stripe and 1UP Heart to charge your selected payment method at the beginning of each billing period until you cancel. Monthly subscriptions renew each month. Annual subscriptions renew each year.

Payments are processed by Stripe. Your use of Stripe’s payment services is also subject to Stripe’s applicable terms and privacy practices. We do not receive or store your complete payment-card number.

Supporter access normally begins after Stripe confirms successful payment. A delayed, declined, reversed, disputed, or unpaid transaction may delay, restrict, or end Supporter access.

7. Cancellation and Renewal

You may cancel your subscription through the Supporter section of your 1UP Heart account by selecting Manage Billing and completing cancellation through the Stripe Customer Portal.

Unless the checkout page or applicable law states otherwise, cancellation takes effect at the end of your current paid billing period. You will retain Supporter access until that date and will not be charged for another billing period.

Deleting your 1UP Heart account does not necessarily cancel an active Stripe subscription immediately. Cancel the subscription through Manage Billing before deleting your account, or contact us for assistance.

We may change subscription prices or benefits in the future. Any price change affecting a future renewal will be disclosed in advance when required by law. You may cancel before the new price takes effect.

8. Refunds and Billing Problems

Subscription payments are generally non-refundable after a paid billing period begins, except where a refund is required by applicable law or expressly offered by us.

Cancellation prevents future renewals but does not ordinarily create a prorated refund for the current billing period. Mandatory cooling-off, cancellation, and refund rights available under the laws of your country or state remain unaffected.

If you believe you were charged incorrectly, charged more than once, or charged after a timely cancellation, contact us promptly at 12g475 at gmail.com. Include the email address associated with your account and sufficient information for us to identify the transaction. Do not send your full card number.

9. Acceptable Use

You may not:

  • Use the service for unlawful, fraudulent, or abusive purposes;
  • Attempt to gain unauthorized access to another account, server, save file, or administrative system;
  • Bypass account limits, subscription controls, security features, or technical restrictions;
  • Upload, transmit, or introduce malicious code, automated attacks, or harmful data;
  • Scrape, crawl, copy, or overload the service using unreasonable automated requests;
  • Interfere with gameplay, site operation, payment processing, or another user’s use of the service;
  • Impersonate another person or misrepresent your relationship with 1UP Heart;
  • Use the service to distribute unlawful material; or
  • Resell or commercially exploit the service without written permission.

We may restrict or suspend activity that threatens the security, stability, legality, or availability of the service.

10. Intellectual Property

The 1UP Heart name, heart logo, website design, original text, software, databases, and other original materials are owned by or licensed to 1UP Heart and are protected by applicable intellectual-property laws.

Game names, characters, artwork, trademarks, software, and other third-party materials belong to their respective owners. References to third-party games, consoles, publishers, and developers are for identification and informational purposes. Unless expressly stated, 1UP Heart is not sponsored by, endorsed by, or affiliated with those rights holders.

Your access to the website does not transfer ownership of any 1UP Heart or third-party intellectual property to you.

11. Copyright Concerns

We respect intellectual-property rights. A rights holder or authorized representative may report material believed to infringe copyright by emailing 12g475 at gmail.com.

A copyright notice should include:

  • Identification of the copyrighted work claimed to have been infringed;
  • The exact 1UPheart.com URL or other information identifying the material at issue;
  • Your name and contact information;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or the law;
  • A statement that the information in the notice is accurate and that you are authorized to act for the rights holder; and
  • Your physical or electronic signature.

We may remove or restrict access to material while reviewing a sufficiently detailed complaint.

12. Third-Party Services and Links

The service may rely on or link to third-party services, including Stripe, hosting providers, authentication providers, analytics services, and external websites. We do not control third-party services and are not responsible for their independent availability, security, content, or policies.

Your use of a third-party service may be governed by separate terms between you and that provider.

13. Service Availability and Changes

We may maintain, update, repair, redesign, restrict, suspend, or discontinue any part of the service. We do not guarantee uninterrupted availability, a particular game library, permanent compatibility, or error-free operation.

If we permanently discontinue a paid feature during an active subscription period, we will take reasonable steps to prevent future renewals and provide any remedy required by applicable law.

14. Suspension and Termination

We may suspend or terminate an account if we reasonably believe that the user:

  • Materially violated these Terms;
  • Created a security, fraud, or legal risk;
  • Used the service in a way that harmed other users or the service; or
  • Failed to pay an amount properly due.

Where reasonably possible, we will provide notice and an opportunity to correct the issue. Serious abuse, fraud, security threats, or unlawful conduct may result in immediate action.

You may stop using the service at any time. You may delete available account data through account tools or contact us for assistance. Subscription cancellation must be completed separately as described above.

15. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Nothing in these Terms excludes warranties or consumer protections that cannot legally be excluded in your jurisdiction.

16. Limitation of Liability

To the maximum extent permitted by law, 1UP Heart will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, saves, profits, revenue, goodwill, or business opportunities arising from use of or inability to use the service.

To the maximum extent permitted by law, our total liability for claims relating to the service will not exceed the greater of:

  • The amount you paid to 1UP Heart during the 12 months before the event giving rise to the claim; or
  • US $100.

These limitations do not apply where liability cannot legally be excluded or limited.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold 1UP Heart harmless from third-party claims, liabilities, and reasonable expenses resulting from your unlawful use of the service, your material violation of these Terms, or your infringement of another person’s rights.

18. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles.

Any dispute not subject to mandatory local consumer jurisdiction will be handled by the state or federal courts located in Washington. If you are a consumer outside Washington, this section does not remove any mandatory rights or protections provided by the laws of your place of residence.

19. Changes to These Terms

We may update these Terms to reflect changes to the service, subscriptions, laws, security requirements, or business practices. The updated Terms will be posted on this page with a revised “Last updated” date.

If a change materially affects an active paid subscription, we will provide additional notice when required by law. Continued use of the service after updated Terms take effect constitutes acceptance to the extent permitted by law.

20. General Terms

These Terms and the Privacy Policy constitute the agreement between you and 1UP Heart concerning the service. If any provision is found unenforceable, the remaining provisions will remain effective.

Our failure to enforce a provision is not a waiver of that provision. You may not assign your account or rights under these Terms without our permission. We may assign these Terms as part of a reorganization, transfer, or sale of the service.
